Welcome to www.milenamakani.com (the “Site”). The Site is owned and managed by artist Milena Makani (“I”, “me”, “my”). These Terms and Conditions (“Terms”) govern your use of the Site and any purchases from my webshop / via invoice. They serve as an integral part of any Invoice to which they are attached. By accessing the Site or receiving an Invoice or placing an order, you agree to these Terms. If you do not agree, please do not use the Site or proceed with a purchase.

  1. Use of the Site

You are prohibited from copying, reproducing, distributing or otherwise using any images or content without my written permission. You must not use the Site for illegal purposes or post harmful content. You may only view and purchase Artwork for personal or professional display in private or office spaces. I reserve the right to suspend or terminate your access and take legal action as required in case of breaches.

  1. Artwork and Orders

My original paintings are available for purchase, consignment and licensing exactly as described on the product pages. Colours may vary slightly due to differences in screens. All paintings are titled, dated and signed on the back of the artwork and include a dated and signed Certificate of Authenticity. Paintings ship unframed in protective wrapping rolled in a hard, wide tube. Framing advice is available on request.

To purchase, email me at art@milenamakani.com with desired artwork titles, recipient name, shipping and billing address (if different) and preferred payment currency. Within 12 hours, I will provide you with an Invoice including artwork details, payment instructions and shipping information. Only original paintings are available for purchase. Inquiries about prints, commissions or NFTs will not be answered.

  1. Payment and Security

You must ensure that all shipping and billing details you have provided are accurate prior to payment. Payment is accepted via PayPal, credit card or bank transfer (currencies: GBP, EUR, CHF, USD and CAD). Full payment is required upfront and before the due date on the Invoice. Until payment is received, I will not sell the artwork to another party. If payment is not received by the due date, your intent to purchase is considered revoked and I have no further obligation to you.

  1. Shipping and Delivery

Shipping is free of charge worldwide except for areas with disrupted or sporadic postal service. I ensure artwork is packed securely for shipping. Upon dispatch, tracking information will be provided immediately and risk of loss transfers subject to the laws of your country of residence. While original paintings are exempt from import taxes and duties in most countries, any such costs where applicable are payable by you. You agree to comply with all local customs and import regulations. I make every effort to eliminate import costs.

  1. Returns, Refunds, Damage and Loss

Statutory consumer rights apply as per your country of residence. Furthermore, I offer voluntary 7-day returns. Artwork may be returned undamaged and in its complete original packaging including Certificate of Authenticity within 7 days of delivery for a full refund. Return shipping costs and any re-import customs costs (if applicable) are payable by you. Email art@milenamakani.com for return instructions. In the unlikely event the artwork arrives damaged, email photo/video footage of the damaged packaging and artwork within 24 hours of receipt to art@milenamakani.com for resolution.

  1. Ownership, Copyright, Care, Display and Resale

You acknowledge that I retain all copyright and ownership rights to the Artwork even after physical ownership passes to you. You have the right to display the Artwork in private or office spaces but may not reproduce, alter or create derivative works without my prior written permission. Public, commercial or exhibition display requires prior written consent to protect artistic integrity and prevent misuse or false contexts. Any such requests require a separate agreement.

If you wish to sell or transfer the Artwork, you agree to notify me in writing beforehand and transparently share details of the resale/transfer and new owner for archival purposes.

  1. Intellectual Property

All artwork, images and Site content are owned exclusively by me, Milena Makani. Purchasing artwork grants only use and display rights as outlined above. Infringers will face legal action under applicable copyright laws in your jurisdiction.

  1. Limitation of Liability

I provide the Site and artwork “as is” without warranties. I am not liable for indirect losses such as data loss, business interruption or misuse. My total liability is capped at the order or Invoice value and does not exclude statutory consumer rights applicable in your country. I am not responsible for shipping delays or losses once dispatched.

  1. Data Privacy

Please see my Privacy Policy for details on how I handle your personal data in compliance with applicable data protection laws, including UK GDPR and international regulations.

  1. Governing Law

These Terms are governed by English law. Any disputes will primarily be resolved through the courts in England, except where local mandatory laws of your country apply. International buyers acknowledge that their local consumer protection laws may provide additional rights.

  1. Changes

I may update these Terms from time to time. Your continued use of the Site or artwork purchase after changes implies acceptance. Please consult these Terms prior to purchase.
